The movement to electronic health records is an important step toward the interoperability of medical information. However, health care organizations must walk a fine line when it comes to communicating information across health care channels. HIPAA has mandated strict processes for PHI. Breaches involving huge fines are becoming more frequent in news headlines. Consider the following posted on the HIPAA website:

“Imagine doing a routine online search and having the search engine serve up files that include medical histories, notes from psychiatric sessions and children’s medical exams, sensitive information about drug abuse or pregnancy loss, and personal data like Social Security and driver’s license numbers. That suggests a breach that “uh-oh” doesn’t begin to cover. The FTC’s lawsuit (https://www.ftc.gov/news-events/press-releases/2014/01/provider-medical-transcript-services-settles-ftc-charges-it) against GMR Transcription Services – the agency’s 50th settlement in a data security case (https://www.ftc.gov/system/files/documents/cases/140131gmrstatement.pdf) – underscores the importance of safeguarding sensitive information regardless of whether the people working for you are across the hall, across town, or across the ocean.” (https://www.hhs.gov/hipaa/for-professionals/special-topics/mental-health/index.html)

This important webinar will cover benefits and issues with EHRs and the increasing importance of the quality of care information captured in the medical record. Learn the principles of medical record documentation and clinical documentation. Maxine will address these questions and many more:

  • Who owns a medical record?
  • What is the difference between a Court Order and a Subpoena for medical records?
  • What are the types and requirements of subpoenas?
  • A State law requires that a health care provider give individuals one free copy of their medical records but HIPAA permits the provider to charge a fee. Does HIPAA override the State law?
  • A complainant alleged that a mental health office improperly provided her records to her auto insurance company and refused to provide her with a copy of her medical records. Would this be a violation of the Privacy Act?

Participants will review published breaches of medical records and state requirements for documentation in the medical record.

Knowledge is power when dealing with the exchange of PHI. We will look beyond the EHR and arm participant with questions to ask when it comes to vulnerable areas such as: online health information exchanges, telemedicine, cloud computing and PHI on portable devices.

She is the former administrator of a multi-specialty clinic and has taught numerous practice management, accounting and business communications courses at various levels at Midwestern State University in Texas.
